The former Kentucky Secretary for Justice and Public Safety was arrested Monday in Lexington and charged with first degree rape.
Former state representative John Tilley, who oversaw Kentucky’s state prison system under former governor Matt Bevin, is accused of having sex at a Lexington hotel with a woman who could not consent because she was too drunk to do so.
The alleged rape is said to have taken place on April 15, but no charges were filed until Monday.
Lexington Police Department has revealed how Tilley turned himself in and is now being held in the Lexington-Fayette County Jail.
‘Mr. Tilley maintains his innocence of any criminal misconduct and has fully cooperated with the investigation,” attorneys Christopher Spedding and Steve Schroering said in a statement.
“He respects the court’s process and will not comment further at this time,” she added.
Tilley had been a representative of the Democratic state and had been appointed by former Republican administration Matt Bevin as a cabinet minister on the Department of Justice.
He was Chief of Cabinet of Justice and Public Safety from December 2015 to 2019, overseeing the Kentucky State Police, the Department of Corrections, and other agencies.
During his time with the public safety cabinet, Tilley worked to reduce the backlog of untested rape kits.

“Survivors of sexual assault should never endure the uncertainty of a new deprivation,” he said in a 2017 press release.
In a 2019 Kentucky State Police press release regarding the agency’s use of new rapid DNA testing for rape kits, Tilley stated, “In Kentucky, we believe in justice. No matter where you live, work or play in the state, you can expect to be safe from crimes of sexual assault.”
Prior to that, Tilley, who is a represented attorney, served five terms as a Democratic state legislator from Hopkinsville in Western Kentucky. He also served as chairman of the House Judiciary Committee.
While he was secretary, he pushed for the reduction of overcrowding in the state prisons and prisons.
“The answer is not to build more prison space, the answer is to reduce our prison population,” Tilley said at the time.
